Boilerplate:(契約書などの)一般的な表現
Bait-and-Switch:おとり商法
Chilling effect:萎縮効果
Laches: 1. Undue delay in asserting a right or privilege, 2. a doctrine permitting dismissal of a suit because a plaintiff’s unreasonable delay in asserting a right or privilege has been detrimental to the defendant’s ability to make a defense. (Merriam-Webster’s Dictionary of Law, Newest Edition)
Pass off:(1) to make public or offer for sale with intent to deceive, (2) to give a false identity or character. (Merriam-Webster’s Dictionary of Law, Newest Edition) 詐称通用
Putative: thought, assumed, or alleged to be such or to exist. (e.g., the child’s putative father) (Merriam-Webster’s Dictionary of Law, Newest Edition)
なお、「putative class action」とは、s brought by one or more named plaintiffs on behalf of a potential group of similarly situated individuals (known as a class) who allegedly suffered a common injury.を意味する。
